Suffolk County prosecutors are furious that a local judge released a previously deported illegal immigrant without bail — even after he was hit with his fourth felony drunken-driving conviction in 10 years.

Pablo Aguilar-Alvarez, 36, was booted from the US in 2024, but snuck back in and was nabbed last year for another driving while intoxicated rap with more than twice the legal limit, prosecutors said.

The boozy immigrant was convicted Friday — only to have Suffolk County Judge Bryan Browns cut him loose before he is due to be sentenced on Oct. 2, the district attorney’s office said Monday.

“There is no question that Pablo Aguilar-Alvarez is a danger to society,” Suffolk County DA Ray Tierney railed in a statement. “Despite multiple prior felony DWI convictions, this defendant once again chose to get behind the wheel after drinking, putting everyone on the road at risk.

“And even now, despite the jury’s verdict, there is nothing to stop him from once again getting behind the wheel and endangering the lives of Suffolk County residents,” Tierney said.

Aguilar-Alvarez was deported on March 1, 2024, after his third conviction, the DA said.

Prosecutors said the Salvadoran national was found guilty of felony DWI after busts on June 16, 2022, and on April 19 and Oct. 11 in 2017 — in addition to a misdemeanor drunken driving rap in 2012.

Despite being deported, he snuck back into the country and was drunk behind the wheel again on Nov. 29, when he pulled into a Southampton gas station for more booze — leading his panicked girlfriend to ask the clerk to call 911, prosecutors said.

Southampton cops caught up with Aguilar-Alvarez nearby, with the migrant allegedly stepping out of the passengers side to try to dupe police into thinking he wasn’t the driver.

But cops weren’t fooled, and conducted a sobriety test that came back with blood-alcohol content of .17, more than twice the state legal limit of .08, the DAs office said.

Alvarez-Aguilar was found guilty at a jury trial on Friday, and faces up to seven years behind bars when he is sentenced on Oct. 2. Despite a request from prosecutors that he be held without bail until then, Browns ordered the immigrant freed without bail until the sentencing.

A rep for the state Office of Court Administration, which represents judges in the Empire State, did not immediately respond to a request for comment on Monday.
