Strange UK rule may see strangers park car on your driveway

A motoring expert has shared a lesser-known law that could result in another road user parking on their private driveway without breaking any laws. Many drivers across the UK know the frustration of returning home only to find that another motorist has blocked their home’s driveway or taken their favourite space on the street.

However, John Wilmot, CEO of the car leasing comparison site LeaseLoco.com, noted that it can be even more infuriating to discover that another motorist has parked on the driveway itself. He explained: “Many homeowners are shocked to find out that a stranger parking in their driveway is not actually a criminal offence, despite it being a clear violation of personal space. This legal grey area can be frustrating, especially if you live in a busy area where it happens regularly, so it’s important to take steps to prevent unwanted parking in the first place.”

While many would see it as a violation of their property, it is technically not against the law for a motorist to park on someone else’s driveway, and neither the police nor the council can remove the vehicle.

Rule 243 of the Highway Code states that motorists must avoid leaving their car in front of an entrance to a property or anywhere you would prevent access for Emergency Services; however, it does not claim that drivers cannot use a driveway.

Nevertheless, motorists tempted to park on another person’s property should be aware that the practice is still considered ‘trespassing’ – a civil offence that the homeowner could take action on.

John recommended that drivers who are unfortunate enough to discover another motorist using their driveway speak to them politely about the issue and put a ‘no parking’ sign at the entrance.

He advised: “While the most effective way to protect your property is installing a driveway gate, putting out simple deterrents like parking bollards or posts, cones and signs can also help to prevent strangers from parking in your driveway.

“If you do find yourself in a situation where you come home and see a stranger parking on your property, remember to never take matters into your own hands, or it can land you in serious trouble.”

Alternatively, drivers were also urged to consider turning the inconvenience into a handy way of making money, with a growing number of Brits renting their driveway – particularly if they live near to an attraction like a football stadium.

He added: “On the flip side, if you live near venues or in busy areas, this situation can be turned into an opportunity, as you could allow other motorists to park in your driveway – on your own terms.

“Renting out your driveway when you’re not using it is becoming increasingly popular and can be a great way to earn some extra income.”
